Mian Alam sued his employer, Hawks International Security Inc.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he worked for defendant as a non-exempt hourly employee at the agreed hourly rate of $8 per hour. Plaintiff contended he worked long hours, often working 12 or more hours per day, as a security guard. Sometimes he worked a full 24-hour shift. However, defendant did not pay him wages for all the hours he worked. In addition, his time was recorded in a hand written time sheet. Plaintiff also alleged that he was not allowed to take uninterrupted meal breaks or rest breaks. When he worked on shifts that exceeded 12 hours, he was not given the opportunity to take a second, uninterrupted meal period.
Plaintiff asserted claims for violations of the Labor Code, including failure to pay overtime compensation, failure to pay minimum wage for each hour worked, and failure to provide accurate wage and hour statements. He also asserted claims for failure to provide required meal periods and rest periods and unlawful business practices.
DEFENDANTS' CONTENTIONS:
Defendants claimed that they had moved and the actual time records were lost. Defendants claimed that plaintiff presented his own hand written time records.
Result
The court entered judgment after a bench trial in favor of Alam in the amount of $52,865 in damages and $3,716 in costs.
