Facts
Plaintiff was a tenant at the Orange Grove Towers apartment building in West Hollywood. He sued Orange Grove for premises liability after he slipped and fell as he was walking down a set of stairs on the property. He also sued Doe defendant Rochelle Sterling, trustee of the Sterling Family Trust, the owner of the premises.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he slipped on water on the stairs after Sterling's gardener/employee watered the stairs. He claimed that there were no warning cones or devices alerting him to the water. He also claimed that Sterling, as landowner, was liable.
DEFENDANT'S CONTENTIONS:
Sterling contended that she was entitled to summary judgment. She argued that she had no duty to warn plaintiff of the allegedly dangerous condition because plaintiff admitted that he already knew about the water on the stairs because he saw the water when he walked up the stairs.
Result
The court granted Sterling's motion for summary judgment.
