Contentions

PLAINTIFF'S CONTENTIONS:
Defendants allegedly failed to timely diagnose and treat plaintiff's ovarian torsion, which ultimately led to the loss of her right ovary and fallopian tube.

DEFENDANTS' CONTENTIONS:
Plaintiff allegedly presented to the hospital on Feb. 26, 2014, complaining of abdominal pain. Plaintiff had allegedly been on oral contraceptives beginning at a young age due to a history of ovarian cysts. She was admitted at the hospital because, though doctors found no evidence of ovarian torsion, it was nevertheless still possible. Doctors later performed a procedure to remove her necrotic and collapsed tube and ovary. Plaintiff was discharged on March 1, 2014.

Defendants denied the allegations and asserted various affirmative defenses. Additionally, defendant Prime Health moved for summary judgment for failure to state facts sufficient to state a cause of action. Prime Health also denied any agency relationship with the individual plaintiffs. Prime Health alleged that it could not be liable for their actions.

Result

The trial court granted Prime Health's unopposed motion for summary judgment.
