Facts

Plaintiff Glenn Vargas, a 35-year-old code enforcement officer, was rear-ended by defendant Robert Snider in Santa Ana. Vargas filed suit for motor vehicle negligence. Snider conceded liability, claiming he misjudged the distance between his vehicle and Vargas' vehicle, but contested Vargas' damages.

The plaintiff claimed various soft-tissue injuries affecting his back, neck, arm, hand wrist and neck, as well as headaches. He received 29 chiropractic treatments. The defendant claimed the impact was low and insufficient to cause plaintiff permanent injuries.

The jury determined that defendant was liable but that plaintiff was not injured. No damages were awarded.

Other Information

The plaintiff filed motions for JNOV and a new trial, which were both denied. Defendant was later awarded $6,100 for costs.
