On July 15, 2004, Anatoli Kouzine and Major State Properties entered into a lease agreement with the owner of the property, Lev Yasnogorodsky. Kouzine failed to pay rent for two months, which caused Yasnogorodsky to serve a notice to vacate. After the tenant vacated the premises, Yasnogorodsky was not able to re-rent the property.
Contentions
DEFENDANT'S CONTENTIONS:
The defense argued that the landlord should not be awarded future money damages and disputed the quantity of past due rent payments.
Damages
Yasnogorodsky sought damages for past due rent, future rent, late fees, and attorney fees and costs.
Result
The court awarded the plaintiff $103,800.
