Facts

Plaintiff Orange County Coastkeeper (OCC) is a non-profit organization focused on environment protection and preservation. OCC sued defendant Vista Metals Corporation of Fontana, California, alleging pollutants were discharged into storm drains and the San Sevaine Flood Control Channel. Ultimately, the pollutants entered the Pacific Ocean. Vista Metals denied all claims.

Result

The parties settled for a total settlement value of $104,627. The settlement included the following elements: 1) zero discharge of storm water from the site up to the 25-year/24-hour storm event, all other SW infiltrated to groundwater; 2) vadose zone sampling to ensure there is no impact to groundwater; 3) payment of $50,000 for Supplement Environmental Project; 4) payment of $52,627 in attorney fees and costs; 5) payment of $2,000 for compliance oversight.
