Defendant Ye Hyung Choi, Jong N. Choi, Jeong-Won Sim, Jae Joon Choi, Jung Yoon Choi Yoo, and Pacific City Bank planned to construct the Lux Plaza project in Los Angeles. Plaintiff C-1 Construction (C-1) performed the demolition work and billed defendants for $63,231. C-1 subsequently filed suit for breach of contract.
Contentions
PLAINTIFF'S CONTENTIONS:
C-1 contended that it was awarded the construction contract for the entire project as general contractor in the amount of $1,720,800, but that the defendants failed to pay progress payments for work performed.
DEFENDANTS' CONTENTIONS:
The defendants countered that C-1 had not been awarded the contract as general contractor for the project. Without their consent, C-1 began construction services on the project and refused to remove their equipment from the site.
Result
The jury found in favor of C-1 in the amount of $184,966 against defendants Ye Hyung Choi, Jong N. Choi, and Jeong-Won Sim. The other defendants were dismissed.
