Plaintiff Lynne Hague was employed by defendant UHY Advisors NY, Inc. (UHY) between April 24, 2006, and Sept. 22, 2006, as an office manager in UHY's Los Angeles office. The position of office manager had been filled by Elena Neff prior to Hague's tenure. Neff had exited the post after developing a life-threatening illness requiring medical treatment. When Neff returned, Hague was terminated.

Contentions

PLAINTIFF'S CONTENTIONS:
Hague contended that she had been promised a position even if Neff returned to her post as office manager. Hague argued that she was terminated because she raised issues about violations of the wage and hour laws by UHY.

DEFENDANT'S CONTENTIONS:
UHY countered that Hague was terminated due to purely business reasons. During Hague's tenure, revenue decreased from a $128,680 profit to a $346,092 loss. UHY terminated 10 employees during that time. The Los Angeles office closed in January 2008 due to lack of revenue and all the employees were laid off except for one who was transferred to the San Jose office. The San Jose office also was eventually closed.

Injuries

Hague alleged she suffered emotional distress.

Result

The jury found in favor of UHY.
