Facts
Melissa Leonard, who was wheelchair-bound and suffered from Friedrich's ataxia, regularly rode the public bus in the Alameda-Contra Costa Transit District. On March 6, 2006, Leonard got on the bus with the assistance of the driver, who did not fasten her seatbelt correctly. When the driver slammed on the breaks, Leonard was thrown onto the floor. Thus, Leonard sued Alameda-Contra Costa Transit District for negligence.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that the defendant failed to adequately train its employees on dealing with wheelchair-bound passengers and on driving habits. Further, the defendant had a non-delegable duty to ensure wheelchair bound passengers' safety.
Damages
The plaintiff claimed $8,384 in medical costs.
Result
The parties settled for $100,000.
