Facts
Plaintiff 2M Group Inc. was a marketing firm specializing in luxury brand development. Defendant Solstice Management LLC managed several luxury residences worldwide. In May 2004, 2M Group entered into a written agreement with defendant Solstice Management to provide Solstice Management with marketing and luxury brand management services. Solstice Management would provide 2M Group with a monthly fee and each of 2M Group's principals, Michael Koskie and Meg Goodman, would receive a Solstice Management membership to be used at its worldwide luxury residences. 2M Group paid a deposit for these memberships. In 2006, 2M Group decided to terminate their agreement with Solstice Management. A dispute developed regarding the ownership rights over materials created by plaintiff for defendant.
Contentions
PLAINTIFF'S CONTENTIONS:
2M Group contended that the materials created for Solstice Management were its sole property and that Solstice Management failed to return the full amount of the deposit for the memberships.
DEFENDANT'S CONTENTIONS:
Solstice Management countered that the promotional materials prepared by 2M Group were its sole property and that it had fully repaid the deposit owed to 2M Group.
Result
After arbitration, 2M Group was awarded $952,152.
