Facts
In 2006, a car driven by Mie Tani collided with a car driven by Sokcevic Predrag in front of Delicia Goodwin as she waited in her car at a red light. The vehicles then proceeded to collide into Goodwin's vehicle. Goodwin sued Tani and Predrag for motor vehicle negligence.
Predrag settled out for $500 before trial.
Contentions
PLAINTIFF'S CONTENTIONS:
Goodwin asserted that Tani and Predrag were traveling in opposite directions. The collision occurred when Tani turned left in front of Predrag.
DEFENDANT'S CONTENTIONS:
Tani asserted that Predrag drove at an excessive rate of speed and ran a red light.
Damages
The plaintiff requested $12,218 in medical costs plus damages for pain and suffering.
Injuries
Goodwin suffered injuries to back, neck, and soft-tissues, which required chiropractic treatment.
Result
The jury awarded Goodwin approximately $20,000 and found Tani was 60 percent liable while Predrag was 40 percent liable. After post-trial motions to reduce damages to the medical costs actually paid, Tani's responsibility for damages was further reduced to $8,829.
