Facts
In 2004, plaintiff Kimberly Williams, 36, was a trainee with the defendant Union Pacific Railroad (UPR). Williams was training as a brakeman/switchman at UPR's Roseville Terminal under a white male supervisor with 39 years experience on the railroads. Williams was terminated on the last day of her training program. Williams' fellow trainees allegedly told her that the supervisor was intent on getting rid of her and revealed his discriminatory motives by referring to Williams as a "lazy n----- whore" amid other expletives. Williams filed a complaint with UPR's Equal Employment Opportunity department and referred them to the two witnesses on her behalf.
Contentions
PLAINTIFF'S CONTENTIONS:
Williams contended that she was discriminated against based on her race and sex. Despite her official complaint, UPR failed to investigate the allegation and reverse her termination.
DEFENDANT'S CONTENTIONS:
UPR denied all allegations.
Result
The jury found in favor of Williams in the amount of $1,616,392.
