Defendant
Facts
Between 2004 and 2005, plaintiffs Keisha Brison, Brenda Lee, Devaughnte Gory, and Carletha Lee resided in an apartment building owned by defendant Michael Braum and managed by defendant Braum Real Estate. In 2005, they were evicted.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that they were evicted based on racial discrimination and for reporting problems with the building that were never repaired.
DEFENDANTS' CONTENTIONS:
The defendants countered that plaintiffs were evicted because they were disruptive tenants who harassed the other residents. The defendants argued that on at least one occasion, police had to be called to remedy a disturbance caused by plaintiffs. The defendants denied that they refrained from making needed repairs to the building.
Damages
The plaintiffs sought approximately $700,000 each in damages.
Injuries
The plaintiffs suffered emotional distress and mold-related physical injuries.
Result
The court dismissed the complaint for failure to meet pre-trial deadlines.
