Facts

Plaintiff Lori Moll's car was in the middle of a three-car accident. Defendant Lauren Emmert and UIM provider, Farmers Insurance, initially claimed that plaintiff's car initially rear ended vehicle number one, causing injury and that second rear end impact by Emmert was only minor contributor.

Medical expenses were $300,000 pre-Howell adjustment, which would have been significant.

Injuries

Plaintiff suffered herniated cervical discs, including impingement and deformation of spinal cord and C5-6. Treatment included epidural injections, and facet rhizotomy before surgery. Plaintiff underwent surgery of the anterior cervical discectomy with decompression of spinal cord and nerve roots at C4-5 and C5-6, followed by insertion of synthetic disc replacements at both levels.

Result

This matter was settled with the third party insurance for $100,000 policy limits; the underinsured motorist claim was then settled for $150,000 policy limits.
