Facts

Terri Brown filed a complaint against Ralph's Grocery Co. for allegedly violating section 8(a)(1) of the National Labor Relations Act by maintaining and enforcing an unlawful arbitration policy precluding employees from acting collectively or as a class otherwise exercising their rights under the Act. Ralph's denied all allegations.

Result

Administrative Law Judge Eleanor Laws found Ralph's in violation of section 8(a)(1) by enforcing a mandatory and binding arbitration policy that required employees to relinquish any rights to resolve disputes through collective or class action. Judge Laws then ordered Ralph's to cease and desist from further violations of the Act.
