Facts

Plaintiffs Mary Cobb-Jackson and Yvette Hernandez sued the City of Oakland, former Oakland Police Chief Howard Jordan, Captain Ersie Joyner III, and Officer Cesar Garcia, alleging wrongful death in connection with an officer-involved shooting that occurred in 2011.

Plaintiffs are the mothers of decedents Fletcher Jackson and John Sloan. Decedent Jackson's minor son was also plaintiff in the case.

Contentions

PLAINTIFFS' CONTENTIONS:
Defendants allegedly shot the decedents without justification after receiving a tip that a crime was about to occur. Plaintiffs claimed decedent Jackson, who was unarmed, was shot as he was trying to flee. Plaintiffs asserted claims for wrongful death and civil rights violations.

DEFENDANTS' CONTENTIONS:
Defendant officers received a tip that gang members were about to carry out a "hit" or an assassination. As such, the police intervened and, in the process, shot and killed the decedents.

Result

The city agreed to settle the action for $75,000.
