Facts
On September 14, 1993, the plaintiff, Neva Arcuri, a 53-year-old homemaker, was operating her vehicle westbound on El Camino Street when she was rear ended by a vehicle operated by the defendant, Victoria Williams. The plaintiff was taken from the scene by an ambulance to the hospital emergency room. After one doctor's visit (post emergency room visit), the plaintiff did not seek treatment for approximately 3+ months. During that period, the plaintiff cancelled one doctor's appointment and when she did visit the doctor, she complained only of a sore throat. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
