Facts

On February 5, 1996, the plaintiff, John Pfarr, a _-year-old __________ (occupation pls.), presented to the defendant, Dr. Thomas Darrah, at the defendant hospital, Longmont United Hospital, in Longmont, Col. for back surgery. During the night, the plaintiff began to show signs of cauda equina syndrome. The defendant (???), Karen James, a nurse and employee of the defendant hospital, called the defendant, Dr. Darrah, at 5:45 a.m. on February 6, 1996, and told him of the plaintiff's symptoms. Dr. Darrah came to the hospital at 9:00 a.m. and returned the plaintiff to surgery to remove a hematoma that he believed was causing the cauda equina syndrome symptoms. After the second surgery, the plaintiff regained some ability to walk but has incomplete paraplegia including loss of bowel, bladder and sexual functions. The plaintiff brought this action against the defendants, the doctor and hospital, based on negligence and medical malpractice theories of recovery. The plaintiff's wife, brought this action based on a loss of consortium theory of recovery.
