Facts
On August 31, 1993, the plaintiff, Edward Rom, a 57-year-old insurance broker, was operating his vehicle when he was rear ended by a vehicle operated by the defendant, Laura Legg. The defendant, Legg, admitted liability, but disputed the nature and extent of the injuries attributable to the rear end collision as the plaintiff was involved in a pedestrian accident (where he was knocked down in a parking lot) on October 14, 1993. The plaintiff settled the pedestrian case for $20,000 and proceeded to trial on the rear end accident case. The plaintiff brought this action against the defendant, Legg, based on negligence theories of recovery.
Settlement Discussions
The plaintiff made a settlement demand for $150,000. The defendant made a C.C.P. º998 offer of compromise for $5,000.
