On Feb. 24, 1994, plaintiff Judith M. Land, a 44 year-old nurse, was stopped at a red light when she was rearended by a defendant Yellow Cab taxi, driven by defendant David Cantrell. The accident occurred as the plaintiff was applying lipstick while looking in the rearview mirror. The plaintiff brought this action against the defendants, the taxicab company and the driver, based on a negligence theory of recovery.
