Defendant Thu van Nguyen had a 25-percent partnership interest in the plaintiff, Queen Cleaners, a dry cleaning
store. While working there, the defendant handled all of the accounting as well as the day-to-day operations.
Pursuant to a preliminary injunction, the defendant was locked out of the plaintiff, and the plaintiff filed a
complaint to buy out the defendantÆs share of the partnership.
The defendant filed a cross-complaint for breach of fiduciary duties and fraud against the
plaintiff/cross-defendants for locking her out of the cleaners and for withholding her shares of net
profit from the partnership.

Settlement Discussions

The defendant/cross-complainant offered $59,999 prior to trial.

Result

The judge rendered a decision granting plaintiffÆs request to remove the defendant/cross-complainant from the partnership and awarded the defendant/cross-complainant $45,000 for the partnership interest in Queen Cleaners and $5,000 for breach of fiduciary duty against the plaintiff/cross-defendants.
