Facts
On March 16, 1999, an Aurora Public Schools bus slammed into the rear of an RTD bus at the itersection of Airport Boulevard and 10th Avenue. Janet Tomich was the driver of the empty school bus. Ninetten passengers on the RTD bus filed claims under the governmental immunity ACT. Candice Pelan, who was a passenger on the RTD bus, claimed she was injured as a result of the accidnet. The defendants denied the plaintiff's allegations and denied negligence and causation.
Settlement Discussions
There was a $65,000 demand prior to trial and a $10,000 offer of settlement.
Injuries
The plaintiff allged soft tissue injuries to the neck and back and a mild traumatic brain injury. RTD PIP paid $19,000 in medical bills.
Result
The jury found that Tomich was negligent, and the accident caused the plaintiff's injuries.
