Facts
On Aug. 20, 1996, Heinrichs, Atighechi and Rumer were involved in a three-car collision on 30th Street in Boulder. Atighechi drove the first car, a 1984 Toyota Celica, followed by plaintiffÆs vehicle, a 1988 Honda Prelude, and lastly RumorÆs vehicle, a 1991 Toyota Celica. Brett Heinrichs alleged that he stopped his vehicle behind the defendant Atighechi when Atighechi halted his vehicle mid-block to make an illegal u-turn. But then RumerÆs vehicle hit the rear of HeinrichÆs car forcing his car into the rear of AtighechiÆs vehicle. The plaintiffsÆ alleged that Rumer was driving too quickly for rush hour traffic and was following too closely. Brett Heinrich alleged that he was injured, and his wife claimed loss of consortium. Atighechi denied making an illegal u-turn and claimed that Rumer caused the collision. Rumer alleged that Atighechi was at fault and caused the collision. Both defendants said it was a minor impact with soft tissue injury only.
Settlement Discussions
On Dec. 22, 1999 there was a demand of a $15,000 statutory offer of settlement to each defendant. There was a $0 offer for 4+ years post trauma. One month prior to trial, in February 2001, the defense made a $14,000 statutory offer of settlement from each defendant.
Injuries
Brett Heinrichs suffered soft tissue injury to the back and a torn ligament that resulted in permanent thoracic instability at the T6-7 level. Non-economic losses and physical impairment. Regina Heinrichs claimed loss of consortium.
Other Information
The plaintiffs requested $18,000 for costs. Judge Roan has ruled on costs as of yet.
