Facts
Yen Chen was driving her car on the freeway when she was struck from behind by a trash truck operated by Manuel Garcia. Arakelian Enterprises Inc. owned the truck and was Garcia's employer. The force of impact caused Chen to hit the vehicle ahead of her, which caused a chain reaction. Her vehicle was a total loss. She sued Arakelian for negligence. Her husband, Ken Wong, sued for loss of consortium.

Chen suffered from dizziness, neck pain, shoulder pain, herniated disk, and had to undergo surgery for her injuries. She also alleged emotional distress.

Chen was also found at fault and her award in the judgment was $332,695, which consisted of $71,000 for past medical expenses; $60,000 for future medical expenses; $3,661 for past loss earnings; $35,000 for past pain and suffering; $200,000 for future pain and suffering. Wong received $0 in the settlement.
