On Sept. 27, 2013, plaintiff Jennie Angeles, 90, boarded a Los Angeles County Metropolitan Transportation Authority bus, driven by defendant Alvaro Valencia. Plaintiff sued Los Angeles County, LACMTA and Valencia, an employee of LACMTA, claiming the bus movement caused her injury.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that before she could take a seat or hold onto anything, the bus driver pulled away from the curb. The movement of the bus threw her down. Plaintiff claimed that she broke her hip requiring future medical care and causing her pain and suffering.
DEFENDANT'S CONTENTIONS:
The city claimed that although they were responsible for her fall and broken hip, the damages sought by plaintiff were excessive and she did not need future medical care.
Injuries
Plaintiff claimed a broken hip. She was at the hospital for six days where they did an open reduction internal fixation surgery and installed a screw in her hip. After the surgery, she spent three and a half months in a rehabilitation center.
Result
Plaintiff's verdict for $750,000.
