PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant violated the TCPA by calling plaintiff and the other class members on their cell phones via an autodialer for non-emergency purposes without their prior express consent.
DEFENDANT'S CONTENTIONS:
Defendant denied any wrongdoing.
Result
Pursuant to the parties' agreement, defendant will pay class members a total of $2.75 million. Payouts to individual class members were capped at $1,500 each.
