Contentions
PLAINTIFF'S CONTENTIONS:
Defendant Dale Isaacs allegedly contacted plaintiff to provide printing and mailing services to defendant Buyers Choice. Isaacs claimed to be the president of the company, which was located in the State of Washington and did direct mail advertising in that state. The parties thereafter entered into an agreement, but defendants breached the agreement by failing to pay plaintiff for the services plaintiff performed. As such, plaintiff sued defendants for breach of contract and related claims, seeking $292,708 in damages. Plaintiff asserted that the individual defendants should be held liable for the company's debts.
DEFENDANTS' CONTENTIONS:
Defendants denied owing plaintiffs anything. Defendants asserted various affirmative defenses.
Result
The parties agreed to settle their dispute. As part of the settlement, defendants agreed to pay West Coast $100 and the quitclaim of the Arizona property required to pay off the existing mortgage. The Isaacs also agreed to transfer all rights and interest to real estate located in Arizona, including all the furnishings inside the property in full satisfaction.
