Tibor Sarkany sued Robert Valenzuela for negligence after Valenzuela rear-ended Sarkany's vehicle.

Contentions

PLAINTIFF'S CONTENTIONS:
Sarkany contended that his vehicle was rear-ended by a vehicle driven by Valenzuela as Sarkany was at the intersection of Mission Boulevard and Anza Street in Fremont. He claimed that Valenzuela negligently operated his vehicle.

DEFENDANT'S CONTENTIONS:
Valenzuela did not dispute liability but contested Sarkany's injuries.

Injuries

Sarkany claimed a tear to his right shoulder's rotator cuff for which he eventually underwent surgery to repair.

Result

The jury returned a defense verdict, finding that Valenzuela's negligence was not a substantial factor in causing Sarkany harm.
