Facts
Plaintiff Fredric Roberts was walking on South Van Nuys Avenue in San Francisco in November 2009, when he entered the intersection of 17th Street and was struck by a pickup truck driven by defendant Jose Espinoza, making a left turn.
Roberts died while the case was pending.
Contentions
PLAINTIFF'S CONTENTIONS:
Roberts filed suit against Espinoza, alleging failure to yield to pedestrian traffic. Roberts contended that Espinoza caused the accident and his injuries by being inattentive in making the left turn, and failing to notice him in the crosswalk.
DEFENDANT'S CONTENTIONS:
Espinoza contended that Roberts ran into the truck's path right before impact, causing the accident.
Specials in Evidence
$1,000,000. Roberts was not liable for the medical bills.
Damages
Roberts sought $1.25 million in medical expenses.
Injuries
Roberts sustained multiple head and brain injuries.
Result
The parties reached a settlement for $500,000. The case settled after three days of in limine motions.
