Facts

A class action was filed against MEGA Brands Inc., manufacturer of magnetic toy products, that were the subject of recalls by the Consumer Products Safety Commission (CPSC), alleging that the toys contained defective magnets. The lawsuit did not allege any personal injury claims stemming from the allegedly defective magnetic toys.

Result

MEGA agreed to settle the matter by providing a full refund for each eligible toy purchased. MEGA also agreed to contribute $100,000 in cash and product toward the establishment of a charity foundation as part of the settlement.
