Facts

Firefly Digital Inc. sued Google Inc. for trademark infringement and unfair competition related to Google's "Google Gadgets" product. Firefly asserted trademarks for "gadget" and "website gadget." Google filed for summary judgment and motion to cancel Firefly's federal- and state-registered trademarks.

Result

U.S. District Judge Tucker L. Melancon granted Google's motion for summary judgment and motion to cancel the registered trademarks and ruled that the terms "gadget" and "website gadget" were generic and descriptive.
