Facts

On Feb. 22, 2009, Ronald Coburn was riding his motorcycle when he collided with a truck at the intersection of National Avenue and 31st Street in the City of San Diego.

Contentions

PLAINTIFF'S CONTENTIONS:
Coburn filed suit against the City and the driver of the truck. Coburn alleged that the intersection was dangerous due to the City's failure to install a four-way stop or light and failure to maintain a red curb the City had installed at the northeast corner of the intersection in 2001 and which had been painted grey and failure to properly place the stop limit line on 31st street.

Damages

Coburn sought $5.8 million in damages for medical costs, pain and suffering, as well as lost wages.

Injuries

Coburn sustained extensive injuries from the accident. He could not remember the accident.

Result

Coburn settled with the driver of the truck for his policy limits. The jury rendered a special verdict in favor of the City of San Diego finding no dangerous condition.
