Eng Heng was riding in a vehicle traveling eastbound on 2nd Street in San Rafael on May 27, 2007, when the vehicle was involved in a chain reaction rear-end accident at the intersection of B Street. Heng's vehicle was rear-ended by an SUV operated by Peter Demopoulos.
Contentions
PLAINTIFF'S CONTENTIONS:
Heng filed suit against Demopoulos, alleging motor vehicle negligence. Heng contended that Demopoulos failed to slow down in order to stop and avoid the impact.
DEFENDANT'S CONTENTIONS:
Demopoulos alleged that Heng's vehicle initially rear-ended the SUV in front of it, causing any injuries.
Damages
Heng sought $4,176 in damages for past medical costs, as well as future medical costs, $10,000 for past lost earnings, and $30,000 to $50,000 in pain and suffering.
Injuries
Heng claimed back and neck injuries, and underwent chiropractic treatment.
