Facts
A class of plaintiff who bought or received as gifts new televisions manufactured by Philips Electronics North America Corp. and Funai Corp. Inc, including several models of plasma flat screen televisions, filed a class action against Philips and Funai.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs claimed that Philips produced and sold plasma flat screen televisions with "Philips" and "Magnavox" brand names at retailers in the country, and alleged that the televisions contained design defects. Plaintiffs alleged that these defects caused failures of internal components, capacitors, which made the televisions inoperable. Specifically, plaintiffs alleged violations of state deceptive trade practice laws, breach of implied warranty, as well as unjust enrichment.
Result
The parties reached a settlement whereby class members may be entitled to a partial cash refund or transferable voucher that can be used for Philips products.
