Facts
Tomeka Williams was driving on the freeway with her toddler, Judea Doquoi, in the back seat strapped in his car seat, when a vehicle operated by Mario Campus spun out, sideswiping Williams' car. The impact caused her car to swerve across traffic before coming to a halt. Williams and Doquoi sued Campos for negligent operation of a vehicle.
Contentions
DEFENDANT'S CONTENTIONS:
Defendant contended that his manual gear shifter malfunctioned, causing his car to spin out and strike Williams' vehicle. He denied being negligent in causing the accident.
Damages
Williams sought in excess of $25,000 in damages for her past medical expenses and pain and suffering. Doquoi sought $500 for the past medical visit.
Injuries
Williams was treated at an urgent care facility the day after the accident. She complained of strains and sprains on her neck and back. She treated with an orthopedist and chiropractor from February to November 2008. Her son also presented at the urgent care facility, but he did not sustain any serious injury. Williams claimed that she continued to suffer from residual pain and discomfort in her neck and back. Campos disputed Williams' injuries.
Result
The jury rendered a defense verdict.
