Anthony and Debra Hanna, individually and as Trustees of the 2001 Anthony J. and Debra F. Revocable Trust, filed a complaint against CapWest Securities Inc., Ronald Ellis, Dale Hall, Kathleen Heshelow, Lawrence Lambert, Michelle Langer, David Smith, and Robert Tweed related to investments in real estate securities.

Damages

Claimants sought a rescission of the purchase of securities including the return of $2,617,452 paid, plus interest, costs, and punitive damages.

Injuries

Claimants asserted fraud, misrepresentation, negligence, breach of contract, and breach of fiduciary duty.

Result

The arbitration panel recommended expungement of Ellis and Smith's records. However, the panel denied Hall, Heshelow, and Lambert's requests for expungement. All other relief was denied.
