Facts

In June 2011, Jon Carpenter, who used a wheelchair, went to AMJ Management Inc. He filed suit against AMJ, alleging violations of the Disabled Persons Act. He claimed that the AMJ parking lot did not have adequate handicapped parking because he did not have enough space to deploy the access ramp of his vehicle in order to exit.

AMJ argued that the parking lot provided adequate handicapped parking access and that based on the dimensions of Carpenter's vehicle, he should have had sufficient room to deploy his wheelchair.

Result

The Court ruled in favor of AMJ.
