Facts

Jeanine Carbett was walking through a campground when a minor on a skateboard collided with her, causing her to fall to the ground and strike her head. Carbett sued the teen, Aiden Earls, for negligence. Aiden claimed that the 56-year-old plaintiff saw him before the collision and failed to get out of the way or maintain a proper look out.

Damages

Cabett sought $37,257 in damages for past medical costs and unspecified damages for past and future pain and suffering. Her husband filed a loss of consortium claim.

Injuries

Carbett was transported to the emergency room by ambulance. She sustained a concussion and exhibited signs of post-concussion syndrome. She also sustained a hematoma and a facial laceration that required sutures. Carbett claimed to experience vertigo, nausea, headaches, and memory loss even months after the accident. She also claimed to suffer from visual disturbances.

Result

Prior to trial, the parties negotiated a $300,000 settlement.
