Facts

The Equal Employment Opportunity Commission filed suit against Walmart Inc. on behalf of a Walmart Assistant Manager, alleging federal religious discrimination under Title VII of the Civil Rights Act of 1964.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended he observed the Sabbath by refraining from work on Sundays, and Walmart accommodated his request not to work on Sunday until 2009, when it changed its scheduling system. After this point Walmart refused to accommodate his religious beliefs, scheduled him on Sunday, and began to discipline him and logging each absence when the employee could not switch shifts with other employees.

Result

Defendant agreed to pay $70,000 and to institute preventive measures such as training human resource personnel on retaliation and religious accommodation.
