Facts
Pellarin Construction Group, a Redwood City construction company, allegedly dumped hazardous waste into a dumpster that later exploded inside a Recology truck, sending three garbage employees to the hospital from exposure to toxic fumes. Charges were filed against Pellarin in a civil lawsuit alleging violations of environmental protection and workplace safety laws.
Pellarin allegedly dumped five plastic containers containing hydrochloric acid, ammonia, Marine Resin, and drain cleaner with sulfuric acid in a dumpster it shared with other businesses. Those materials were then thrown into a Recology truck where an explosion occurred, spewing liquid substance and creating smoke that was then inhaled by three workers. The workers suffered breathing difficulties and eye pain. One of the workers vomited. They were then sent to the hospital for treatment.
Result
Without admitting any wrongdoing, Pellarin agreed to a $77,878 settlement.
