Gerhard Rohloff filed suit against Jeffrey Arburn, Impact Financial Management LLC, Whitehall-Parker Securities Inc., and Grubb & Ellis Securities Inc. Rohloff asserted causes of action for financial abuse of an elder, suitability, breach of fiduciary duty, fraud, supervision, breach of contract, negligence, breach of the implied covenant of good faith and fair dealing, failure to observe high commercial standards, and respondeat superior. The causes of action related to various tenant in common interests purchased by Rohloff.
Damages
Rohloff requested $3,660,429 in compensatory damages, in addition to consequential and punitive damages.
Result
The arbitration panel recommended the expungement of all references to the arbitration in Arburn's registration records. Otherwise, the panel found that Rohloff's claims were false and denied him the relief he requested.
