On Jan. 24, 2010, while riding his bicycle in a crosswalk at the intersection of Las Tunas and Muscatel in Temple City, plaintiff Christopher Martinez was struck by a vehicle driven by defendant Luis Lara. Lara was in the course and scope of his employment as a delivery person for Southern California Pizza Company at the time of the incident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed he entered lawfully into the crosswalk, and that Lara negligently failed to observe Plaintiff in the crosswalk as Lara entered into the intersection on a green light.
DEFENDANTS' CONTENTIONS:
Defendants claimed that Lara's view of Plaintiff was obstructed by another vehicle, and that Plaintiff was the cause of the accident.
Result
The jury awarded Plaintiff $107,852 in damages. The jury also found Plaintiff 50 percent comparatively negligent, reducing Plaintiff's verdict to $53,926.
