Plaintiff Emily Gallup formerly served as a mediator for the Family Court in Nevada County. She filed a whistleblower suit against the Superior Court, Sean Metroka, and Thea Palmiere on a retaliation theory following her termination. Gallup claimed she was fired after she reported that the court had failed to follow state laws in its operation. Gallup's concerns included, among others, "a dispute over whether criminal records could be accessed in some cases; the time allowed for mediation; reviewing of court files;" and a judge's undue influence involving a custody case.

Settlement Discussions

Plaintiff made a CCP 998 offer of $750,000. Defendants made a CCP 998 offer of $50,000.

A verdict was rendered in favor of Gallup. She was awarded in excess of $313,206.
