On Nov. 10, 2010, at 12:15 p.m., Anthony Simos, 47, was driving when a FedEx truck, driven by Seroj Sepanian, cut him off. Simos swerved left and was injured. He then sued Sepanian and FedEx Ground Package System Inc.
Contentions
PLAINTIFF'S CONTENTIONS:
Simos argued that Sepanian had been driving dangerously and swerved in front of him, causing him to swerve left and into a curb.
DEFENDANT'S CONTENTIONS:
Sepanian contended that Simos was at fault for his own accident, because he had simply overreacted to his truck changing lanes in front of him. Defendant claimed that plaintiff's injuries were degenerative and congenital, due to years of being an athlete.
Damages
Simos sought $59,000 in medical costs.
Injuries
Simos was diagnosed with a lumbar disc herniation, which he treated with chiropractic care and epidural injections. Simos didn't get picked up by an ambulance at the scene of the accident and wasn't treated in an emergency room.
Result
The parties settled for $125,000.
