Facts

Vista Del Sol Health Care Services Inc., doing business as Vista Del Sol Healthcare, sued the National Labor Relations Board Region 31, seeking a declaratory judgment and injunction.

Contentions

PLAINTIFF'S CONTENTIONS:
In 2013, a petition for union certification began to circulate before the NLRB in an effort to unionize Vista's employees. Vista claimed that the union was visiting Vista employees and harassing them to join the petition. The union then brought numerous charges against Vista, through the NLRB, with allegations questioning Vista's business practices.

Result

The court granted the NLRB's motion to dismiss Vista's complaint.
