Omoyi Mvuemba sued the County of Los Angeles relating to his employment with the county.
Contentions
PLAINTIFF'S CONTENTIONS:
Mvuemba was a Medical Case worker employed by the County of Los Angeles's Department of Mental Health. He alleged that he suffered from a chronic spinal health condition, which required among other things, that he stand for five minutes of every hour. He made several requests for disability accommodation to his employer. He was later placed on a "Plan for Individual Improvement" which he claimed was done in retaliation for making the requests. Mvuemba sued the county, alleging violations of the Fair Employment and Housing Act and the Americans with Disabilities Act for disability discrimination, failure to provide reasonable accommodations, failure to engage in good-faith IPMs (Interactive Process Meeting), and retaliation.
DEFENDANT'S CONTENTIONS:
The county contended that Mvuemba's causes of action were either barred because he failed to exhaust his administrative remedies or because he failed to make a prima facie case.
Result
The court granted County of Los Angeles's motion for summary judgment in its entirety.
