Facts

Maria Carrillo De Garcia sued Tayebeh Tina Parvizi and Azam Doost Mahraba after an auto accident.

Contentions

PLAINTIFF'S CONTENTIONS:
On April 7, 2012 Maria Carrillo De Garcia was driving on West Miramar Road in San Diego. She contended that as she was stopped at a red light, she was rear-ended by a vehicle driven by Tayebah Parvizi. She suffered back, shoulder and neck pain as a result. She went to an orthopedic surgeon approximately one month after the collision and subsequently had two months of physical therapy. She sued Parvizi and the registered owner of the vehicle Azam Doostmehraban (erroneously sued as Azam Doost Mahraba), alleging negligent operation. She alleged Doostmehraban was liable under the "permissive use statute" (Cal. Vehicle Code Section 17150).

DEFENDANTS' CONTENTIONS:
Parvizi admitted liability but contended that De Garcia's injuries were minor.

Settlement Discussions

De Garcia made a CCP 998 demand for $12,500. Defense offered $2,800.

Damages

De Garcia sought $6,498 in past medical costs and $1,000 in past loss of earnings as a home daycare operator. She also sought between $10,000 and $17,500 for past pain and suffering.

Injuries

De Garcia claimed soft-tissue injuries to her spine and a strained shoulder. One month after the accident, she claimed pain and numbness in her back and shoulder.

Result

The jury awarded De Garcia $6,498 for past medical costs and $1,000 for past lost earnings, for a total award of $7,498.
