Facts
On Dec. 6, 2013, plaintiff, 20, went to a party at the house of defendant's family. Defendant greeted plaintiff by jumping up and onto plaintiff, knocking plaintiff over. She sued plaintiff for premises liability.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant was intoxicated and that her behavior was reckless and negligent.
DEFENDANT'S CONTENTIONS:
Defendant admitted liability but disputed that she was intoxicated. She disputed plaintiff's claims for future medical expenses.
Damages
Plaintiff sought $1.6 million.
Injuries
Plaintiff sustained an ankle injury and was taken to the emergency room. Plaintiff dislocated her ankle and sustained a trimalleolar fracture. She underwent surgery but developed tarsal tunnel syndrome. She underwent a second surgery to treat the symptoms associated with the tarsal tunnel syndrome. Plaintiff claimed that she suffered continuing pain and weakness and that she was now restricted from engaging in activities she previously enjoyed, such as running and soccer. She also claimed emotional distress due to the scars on her ankle.
Result
The parties settled for $1.1 million. Travelers paid the $600,000 policy limits, and Geico paid the remaining $500,000.
