On May 11, 1991, Plaintiff Randy Ruszezewski, an 18-year-old student, was driving his pick-up truck when it jumped over the curb and ran into a light post. His truck bed passenger, Plaintiff/passenger Mark Lazenby, a 21-year-old salesman, flew out of the bed of the truck and sustained severe and permanent injury. The front seat passenger, Plaintiff Matt Lazenby, was a 17-year-old student at the time and sustained minor injury.
