In January 2009, in response to a Center for Biological Diversity petition, the black abalone was listed as an endangered species under the Endangered Species Act. Subsequently, the Center sued the national marine Fisheries Service for violating federal law requiring the government to protect the species' critical habitat.
Contentions
PLAINTIFF'S CONTENTIONS:
The Center claimed the government failed to designate critical habitat for the abalone, which it had an obligation to do under the Endangered Species Act.
Result
The parties settled, with the federal government agreeing to designate critical habitat for the black abalone.
